Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Social Stamp platform, operated by INSOMNIACS DIGITAL ("Company", "we", "us"). By accessing socialstamp.in or using any of our services, you confirm that you are at least 18 years old and accept these Terms in full.

1. Definitions

• "Platform" means the Social Stamp website, APIs, and related services available at socialstamp.in.
• "Organiser" means a registered user who creates and manages event campaigns on the Platform.
• "Attendee" means any person who accesses an event stamp link created by an Organiser.
• "Campaign" means an event frame or social stamp page created by an Organiser.
• "Content" means any images, text, designs, or other material uploaded to or generated by the Platform.

2. Account Registration

• You must provide accurate, complete information when registering.
• You are responsible for maintaining the confidentiality of your password and for all activity under your account.
• You must notify us immediately at support@socialstamp.in of any unauthorised access to your account.
• One person or entity may not maintain more than one free account.
• We reserve the right to refuse registration or suspend accounts at our discretion.

3. Acceptable Use

You agree not to use the Platform to:

• Upload, publish, or distribute content that is illegal, defamatory, obscene, hateful, or infringes any third-party intellectual property rights.
• Impersonate any person, organisation, or brand without authorisation.
• Create campaigns that are misleading, fraudulent, or designed to deceive attendees.
• Harvest personal data from attendees beyond what is necessary for your event.
• Attempt to circumvent rate limits, scrape the platform, or reverse-engineer any component of the service.
• Upload malware, viruses, or any malicious code.
• Violate any applicable Indian or international law or regulation.

Violation of this section may result in immediate account suspension and potential legal action.

4. Organiser Responsibilities

As an Organiser, you are solely responsible for:

• The content of your frame designs and campaign materials.
• Ensuring you have obtained the necessary rights to any images, logos, or designs you upload.
• Communicating clearly with attendees about how their photos will be used.
• Complying with applicable data protection laws when collecting attendee names and photos through your campaign link.
• Ensuring attendees are aware that their stamped images will be composited and downloaded by them.

5. Intellectual Property

Your Content

You retain ownership of all Content you upload to the Platform. By uploading Content, you grant Social Stamp a limited, non-exclusive, royalty-free licence to store, process, and display your Content solely as necessary to provide the service.

Our Platform

The Social Stamp brand, logo, software, design, and all underlying technology are the exclusive intellectual property of the Company. You may not copy, modify, distribute, or create derivative works of the Platform without express written consent.

Frame Output Images

Composited stamp images (attendee photo + your frame) are generated client-side or server-side for download by the attendee. These images belong to the attendee and the Organiser jointly, subject to any rights in the underlying frame design.

6. Subscription Plans and Payments

• Social Stamp offers a free plan and paid plans as described on our Pricing page.
• Paid plans are billed monthly and renew automatically unless cancelled before the renewal date.
• All prices are in Indian Rupees (INR) inclusive of applicable taxes.
• Payments are processed by Razorpay. By subscribing, you agree to Razorpay's Terms of Service.
• Refunds: We offer a 7-day refund on your first paid subscription if you are unsatisfied. After 7 days or on renewal, subscriptions are non-refundable. To request a refund, email billing@socialstamp.in.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Plan Limits and Fair Use

Each plan includes a monthly stamp limit as described on our pricing page. Stamps are counted per composite image generated. If you exceed your plan limit, your campaign will be paused until the next billing cycle or until you upgrade. We do not charge overages automatically.

8. Termination

• You may delete your account at any time from your account settings.
• We may terminate or suspend your account if you breach these Terms, engage in fraudulent activity, or if we discontinue the service.
• On termination, your campaigns will be deactivated. Campaign data will be retained per our Privacy Policy before deletion.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding reliability, accuracy, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Platform will be error-free or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Social Stamp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of data, revenue, goodwill, or business opportunity. Our aggregate liability for any claim under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim, or ₹1,000, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Social Stamp, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Platform; (b) Content you upload; (c) your violation of these Terms; or (d) your infringement of any third-party rights.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@socialstamp.in.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
